This site is operated by EQUIPT Movement, 7613 Willow Glen Rd, Los Angeles, CA 90046, United States. In these terms, EQUIPT, we, us and our mean EQUIPT Movement. You and your mean the person using the site or placing an order.

2. Eligibility and accounts

You must be at least 18 years old, or the age of majority where you live, to place an order. If you create an account you are responsible for keeping your credentials confidential and for all activity under your account. Tell us promptly if you believe your account has been compromised.

You agree that the information you give us is accurate and current, particularly your delivery address.

3. Products and descriptions

We describe our products as accurately as we can. Weights, dimensions and finishes are given to reasonable tolerances rather than as exact measurements. Colors shown on screen depend on your display and may differ slightly from the product, particularly across our neutral palette.

Products are offered subject to availability. We may change, limit or discontinue any product at any time.

4. Pricing, errors and availability

Prices are in United States dollars and exclude taxes, shipping, duties and import charges unless stated. Prices may change at any time before you place an order.

We take care with pricing, but errors happen. If a product is listed at an incorrect price, or with incorrect information, we may cancel the order and refund you in full, even after you have received a confirmation email. We will contact you if this occurs.

5. Orders

Your order is an offer to buy. Our order confirmation email acknowledges receipt of that offer but does not accept it. A contract is formed when we dispatch the goods.

We may refuse or cancel any order, in whole or in part, including where we suspect fraud, where a product is unavailable, where a pricing error has occurred, where quantities appear intended for resale, or where we cannot ship to the address given. If we cancel an order you have paid for, we will refund you in full.

6. Payment

Payment is taken through our payment providers at checkout. By submitting payment details you confirm you are authorized to use the payment method. We do not store full payment card numbers. You are responsible for any bank or currency conversion charges applied by your provider.

7. Shipping, title and risk

Shipping rates, delivery estimates and duties are set out on our Shipping and Returns page, which forms part of these terms. Title and risk of loss pass to you on delivery by the carrier to the address you provided.

8. Returns, exchanges and refunds

Our returns policy, including the 30 day window, condition requirements and exclusions, is set out on our Shipping and Returns page and forms part of these terms. Nothing in these terms limits your statutory rights in respect of faulty or misdescribed goods.

9. Promotions, discount codes and gift cards

Discount codes and promotions are valid only for the period and on the items stated, cannot be exchanged for cash, and cannot be combined unless we say so. We may withdraw or amend a promotion at any time.

Gift cards are issued in the currency shown, are not redeemable for cash except where required by law, and are not reloadable. Treat a gift card like cash. We are not responsible for gift cards that are lost, stolen or used without your permission.

10. Safe use of our products and assumption of risk

Please read this section carefully.

Our products are weighted exercise equipment. Physical exercise carries inherent risk of injury, and that risk increases when equipment is used incorrectly, when load is increased too quickly, or where an underlying medical condition exists.

  • Consult a physician or qualified healthcare professional before beginning any exercise program, and particularly if you are pregnant or postpartum, are recovering from injury or surgery, or have any joint, cardiovascular or other medical condition.
  • Follow the product instructions and any care guidance supplied. Inspect the product before each use and stop using it if closures, seams or finishes show damage or wear.
  • Do not use ankle or wrist weights for running or other high impact activity.
  • Stop immediately if you experience pain, dizziness, shortness of breath or discomfort, and seek medical attention.
  • Keep weights away from children and pets and store them where they cannot fall.

Content on our site, our blog and our social channels, including workouts and movement suggestions, is general information and is not medical advice, diagnosis or treatment, and is not a substitute for advice from a qualified professional.

To the fullest extent permitted by law, you assume all risk arising from your use of our products and you agree that you use them voluntarily and at your own risk.

11. Intellectual property

All content on this site, including text, photography, video, graphics, layout, and the compilation of that content, is owned by EQUIPT or our licensors and is protected by copyright and other laws. EQUIPT, Ubarre, Uwraps and our logos are trademarks of EQUIPT Movement. The Ubarre is protected by patent.

12. Your content and reviews

If you submit a review, photograph, comment or other content, you confirm that it is your own, that it is accurate, and that it does not infringe anyone's rights or breach any law. You grant us a non-exclusive, worldwide, royalty free, perpetual licence to use, reproduce, adapt and display that content in connection with our business, including in marketing, with attribution where practical.

We may edit or remove content that is unlawful, offensive, misleading or off topic. We do not adopt or endorse any opinion expressed in customer content.

13. Acceptable use

You agree not to use the site to break the law, to infringe rights, to transmit malware, to attempt unauthorized access to our systems, to interfere with the site's operation, to harvest data about other users, or to buy products for resale without our written agreement.

14. Third party links

Our site may link to third party sites and services. We do not control them and we are not responsible for their content, products or privacy practices. Your dealings with them are between you and them.

15. Disclaimer of warranties

To the fullest extent permitted by law, the site and its content are provided as is and as available, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the site will be uninterrupted, secure or error free, or that any content is accurate or complete.

Some jurisdictions do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you.

16. Limitation of liability

To the fullest extent permitted by law, EQUIPT and its officers, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, revenue, data or goodwill, arising out of or in connection with the site or any product, whether based in contract, tort, strict liability or otherwise, even if advised of the possibility.

To the fullest extent permitted by law, our total aggregate liability arising out of or in connection with any product or order is limited to the amount you paid for the product giving rise to the claim.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded.

17. Indemnity

You agree to indemnify and hold harmless EQUIPT and its officers, employees and agents from any claim, liability, loss and reasonable legal costs arising from your breach of these terms, your misuse of the site or our products, or your infringement of any third party right.

18. Governing law and jurisdiction

These terms and any dispute arising out of them are governed by the laws of the State of California, without regard to its conflict of law rules. Subject to section 19, you and we submit to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California.

19. Disputes

19.1 Talk to us first. If something has gone wrong, email info@equiptmovement.com and give us 30 days to put it right. Most issues are resolved at this stage.

19.2 Binding arbitration. If we cannot resolve a dispute informally, you and we agree that the dispute will be resolved by final and binding individual arbitration administered in Los Angeles County, California, under the rules of a recognized arbitration provider, rather than in court, except that either party may bring an individual claim in small claims court.

19.3 Class action waiver. You and we agree that claims will be brought only in an individual capacity and not as a plaintiff or class member in any purported class, collective or representative proceeding.

19.4 Your right to opt out. You may opt out of sections 19.2 and 19.3 by emailing info@equiptmovement.com with the subject line Arbitration Opt Out within 30 days of your first purchase. Opting out does not affect any other part of these terms.

20. General

Entire agreement. These terms, together with our Shipping and Returns policy and our Privacy Policy, are the entire agreement between us on their subject matter.

Severability. If any provision is found unenforceable, the rest remains in force.

Waiver. A failure to enforce a provision is not a waiver of it.

Assignment. You may not assign these terms. We may assign them in connection with a merger, acquisition or sale of assets.

Force majeure. We are not liable for failure or delay caused by events beyond our reasonable control, including carrier disruption, supply failure, natural events, labor disputes or acts of government.

Changes. We may update these terms at any time. The version that applies to your order is the version published when you placed it.
